Barnea’s Real-Estate Department, headed by Adv. Ariel Nadler, has vast experience in advising and managing all types of real-estate transactions, including combination transactions, sell and buy transactions, leases, real-estate purchasing consortiums and expropriation transactions.

Barnea provides a wide spectrum of legal services to its clients throughout all stages of any real-estate project – from the conducting of negotiations, through performing all of the due diligence examinations that are essential before purchasing an asset, the drafting of agreements, the handling of all processes with the authorities and all relevant parties, to attending the registration and transfer of the title to the client.

 

The legal counseling that Barnea provides to its clients encompasses the preparation and drafting of sale contracts, leases or purchase contracts in relation to private and commercial real estate, sales and purchases of assets in receivership proceedings (including as receivers), representation of public companies in various real-estate transactions, real-estate ventures, registration of condominiums, cooperation agreements, and representation of contractors in transactions relating to expropriations and National Outline Plan 38. The firm also provides legal counseling in relation to the real-estate aspects of infrastructure projects.

In July 2018, the Israeli Knesset approved a draft bill in a second and third reading that addresses the obligation of apartment owners seeking to sell a property as a result of a general outline plan to pay land betterment tax.

Israeli Supreme Court Ruling: Property Buyer Required to Pay Betterment Tax if Seller Is Incapable Due to Insolvency Proceedings

According to a ruling handed down recently by the Israeli Supreme Court, when a real estate asset is sold before the seller enters bankruptcy proceedings, and the seller has not paid the betterment tax, the local council is not obligated to grant the buyer approval for registering the property under his name. Thus, the buyer will be required to pay the betterment tax.
